DECISION

Refer to Policy BS17 - Use and Procurement of External Consultants, Procedures PC2008 - Instructions for the Procurement and Payment of External Consultants , and the Consulting Justification Form for information regarding the procurement of consultants. Those documents give specific details regarding the procurement of consulting services. Here are several important points contained in those documents:

Because the Provider has been identified as a Corporate Provider, no Determination of Independent Contractor/Employee Status will be needed to determine if the Provider must be treated as an employee or an Independent Contractor. Consultants will be procured using the REQR function in IBIS.

Refer to Policy BS17 - Use and Procurement of External Consultants, Procedures PC2008 - Instructions for the Procurement and Payment of External Consultants, and the Consultant Procurement Packet for information regarding the procurement of consultants. Those documents give specific details regarding the procurement of consulting services. Here are several important points contained in those documents:

PRIOR to procurement you will be required to use a Determination of Independent Contractor/Employee Status to determine if the Provider must be treated as an employee or an Independent Contractor.

That step is necessary to assure compliance with IRS regulations. Failure to do so may result in substantial fines to the University.

If it is determined that the Provider qualifies as an Independent Contractor, no procurement document is necessary and you will be able to proceed with procurement. Consultants must be procured using an REQR.

Object code 0392 applies.

If it is determined that the Provider must be treated as an employee, then the individual will have to be hired using regular University hiring procedures. (Consult your Human Resource Representative.)

DECISION

PROCUREMENT

No procurement document is necessary.

PAYMENT

A Determination of Independent Contractor/Employee Status must be completed to evidence the fact the provider is not a Penn State employee.

Payment for services rendered must be requested using a Special Request For Check (SRFC); select Purpose "1099HONOR"). The Determination of Independent Contractor/Employee Status must be completed in IBIS as part of the SRFC process.

Object code 0391 shall apply.

Sorry, but Penn State policy prohibits the payment of an honorarium to its employees.

PROCUREMENT

Use a Special Request for Check (SRFC) to request payment for these services.

Numerous service object codes may apply. Choose an object code that pertains to the activity that the individual from the employment agency will be performing. If a specific object code does not exist for the type of activity, then use object code 0411 (Purchased Services).
